I live in AZ and am looking at getting subpeonaed for a case where I am a witness but do not and will not testify. Will they go to another state to serve me? Or can they? And how hard will they try if they do? Please, serious answers only. This is not a laughing matter to me at all. Thanks.

Yes it is the sexual assault case. They already know I recanted and don't want to testify. I do have my own attorney....not sure how good he is...seems pretty useless so far but who knows? He can't ethically tell me to leave or whatever but he has hinted that he's had similar cases to this in the past and nothing happened. I'm the star witness for the prosecution. Without me, they don't have much of a case since I recanted. I just don't want to get subpeonaed. And if they do find me, I'm going to plead the 5th. Don't you love being an American? Yes they can throw me in jail til I testify but after a certain number of days (150) there's nothing they can do cause the statute of limitations is up and they have to drop it. I'm just terrified right now. I hope I'm making the right decision. I was told that it my be good if I do show up to testify cause the State may not even be expecting it. I'm just scared I'm going to make a bad decision but I hope not.

Civil or criminal case. If civil, probably not much effort will be expended. If criminal, it depends on how serious the crime is. If it is a federal case, the federal government can go anywhere to subpoena you. If state, they can serve you but may have to get the state of AZ to order you back to where ever the case is being heard.

Beside America, most other nations law is that if the person/s cannot be serve with any subpoena, the officers will go to the given address for 3 times at different hours and still could not serve the subpoena, they will then paste the subpoena on the door and it is deemed served.
In the other case where no specific address is given, a notice will be posted in the newspaper where a 2 weeks notice is given, where if there is a no show, it will pass judgement in absentia

i got this from someone else's post: the case is sexual assault including kidnapping-for all of the other respondants who wanted to know if it was criminal or civil. I looked into this persons' other questions:)

r u kidding me??? why wouldn't you just testify-sounds like you have something to hide. were you an accessory to this or something. i feel bad for the person suffer through this, the real victim. it sounlds like you would rather do jail time! i hope you do the right thing.

They will issue a Bench warrant for your arrest depending on the size of the case. Most states will honor an extradition. You may be arrested and sent in shackles. However the judge may waive all this. You need to hire your own attorney as each state has different laws.

Yes they can hunt you down and serve a subpeana on you in a different state. I understand you may not Want to testify, but think long and hard...does the assailant belong behind bars? Does another person need to be victomized?

you live in AZ=they know that. Are you considering moving in order to get out of testifying? good luck with that. Do you intend to drive in the new state? they will find you. More details?

Yes, they can serve you pretty much anywhere in the US to serve you. Depending on the case and whether it is criminal or civil makes a difference in how vigorously you will be pursued.

I"am not sure if thay can or not it depens on the case.I hade an atturney tell me once when your being ask questions just say "I dont recall.
