i got a red light ticket the other day through a camera but the under the circumstances, i could not stop. any input is appreciated.

There is no such thing as "I could not stop". If you could not stop in time, then they will say you should have been driving slower. If the weather was bad and you were afraid you'd skid if you stopped, they will say you were driving too fast for road conditions. There are no circumstances where the courts will agree that you "could not stop".

As a former truck driver I can tell you it is your duty to be ready to stop under any circumstances, if the camera shows you running the red light then you should pay the fine and next time be ready to stop. Many people are killed in intersections because of I couldn't stop and the fine you receive is small relative to what can go so very wrong. I figure you won't like this answer but I do hope that you at least think about it. Next time you will be ready to stop.

Trying to explain the circumstances to the issuing agency is a waste of time. Once the citation is written it is sent on to the courts. Even if the agency did want to void the ticket, it's too late. You're going to have to go to court to contest the ticket. Maybe the judge will accept your explanation or maybe he won't.

Best bet, go to court and explain your situation as you told here.

Before going, practice your story over and over, in front of a mirror, in front of a friend, etc. until you can tell it convincingly and with self assurance. Don't insert anything in the story that is implicit in breaking a law, such as you were doing 37 mph (in a 35)--say "I had just checked my speedometer and I was doing EXACTLY 35 mph". Or don't say "My brakes were bad so I didn't want to stop".

Pepper your story with safety issues like "Coming up to the intersection I made sure to check for pedestrians and other traffic but I had to proceed through" and "I've known for months the camera was there so I made certain to be EXTRA CAUTIOUS at this intersection." or "I knew this was a dangerous intersection so I made a point to be EXTRA CAUTIOUS"

Any thing the judge wants to hear that you're a super cautious, nice-little-always-law-abiding safe driver that HAD NO CHOICE but to go through the intersection. Don't hesitate to embellish these points.

Good luck; I hope you win this case based on draconian, fascist thinking (Forget safety, all they want is your money).

By the way I'm hearing that people are fighting these cases lately based on, something like there is nobody as an accuser??? Check it out.

You can plead your case in court, instead of paying the ticket, but remember this, that if you go to court and lose, you pay court costs and have to pay the ticket. I would just pay the ticket and cut my loses.

the state approved the camera. why would you be able to fight it? I don't understand. That question is asked as often as "how do i fight a ticket".

Go to the judge and ask to have the Constable that
gave you the citation to be present in court.

It is your right as a tax payer to have him present.

You can tell the people who handle this stuff (city police, or highway patrol- depending on where it happened and whose jurisdiction you were in) that you were unable to stop and why. Most law-enforcement officers are reasonable if not nice guys and will likely be willing to help if your account holds water.

HEY...I dont know how to beat the ticket but if I were you; I would take a picture of the "fine money" and send it back to them...lol

Unless there was a camera malfunction,no way to beat it.Slow down and you wont have the problem.
