Is there any way to issue a 1099 form without SSN? I have to pay a compensation to a foreign student who does not have her social security number.

Tell her to apply for a TIN. She needs to send form W7 to the IRS with copies of proof of her identity -- the ID pages from her passport will do. When she gets her TIN, she tells you what it is and you give her a 1099.

If the receipient is an LLC, you send the LLC the 1099 (use the EIN). You are not required to determine whther an Independent Contractor is here legally or not. Your are not the USBCIS. --A Damn FIne Tax Advisor

she can apply tax id number, then only u can issue 1099

that would be difficult. You may want to check with the IRS on how to do that, or what information needs to be in place of the SSN.
