i been with my girl for amost 4yr she have my baby boy the problem is that she still married with another guy and by law she have to put him in a birth certificated how can i fix that(put my name in the birth certificate) she is leaving with me

You need to go and get DNA or blood tests done and go to court and prove your the father.
Sorry I know they tried to pull this on me as well

Regardless if she is married and this baby is yours then you have to sign the birth certificate. No law has the right to tell you that you didn't father your son. (If he is your son). If I were you I would get a blood test done. No offense to her but you just want to make sure so that your son has your last name. I don't know abut her you may want to watch your back. She may not be the woman that you think she is. Love is blinded sometimes that you can't see straight. You need to look into this further or go to juvenile court in your town and find out some information about this situation.

Why would she HAVE to put HIM in the birth certificate if he's not the father? You'll have to talk to a lawyer or legal assistant about what you must do to apply for a name change on the certificate. Anyone can change their name at anytime.

I am not sure that she has to put his name, check into it. Where I live, if you are married, the husband does not need to sign or write any thing on the B.C. but if you are not married the father must fill out his portion.

You might have to have a paternity test done. I would take advantage of the free consultations lawyers give, it sounds like you may need one to smooth this road out.

You can have a paternity test done to prove it is your child, then go to the courts and ask for your name to be put on the birth certificate.. good luck to you.
