In light of the answers I already have here..

1. I will be the one recording
2. The 3rd party will be unaware that I am recording him
3. The data is not to be used in evidence in a court of law. (I know that it is not admissable)
4. I am in England - so I'm looking for the interpretation according to the law of England & Wales.

'Covert' isn't the same as illegal.

Its only illegal is you get caught...

If it is only for your own personal use, yes.

If you are going to share this information with a third party, and the person you recorded had a reasonable expectation of privacy, then you could be held civily liable.

if you record a conversation, between yourself and a second party, that is legal, If you want to publish that conversation, you have to ask the second party's permission.

If yo want to use it as evidence, you may in some cases need to warn the person that you are taping the conversation.

As for third party taping you, it depends on where you are having the conversation, and who is taping.

The law has never been defined. If you wish to admit it as evidence, any confession made is likely to be admissable

You answered your own question by using the term covertly.

If you thought it was legal, you wouldn't hide the fact you were recording the conversation, so my answer is: you know the answer.

it depends where you live. in florida its illegal
