My claim for tax credits recently changed as my partner moved out, i am now claiming as i single parent with full child care costs to my 2 children as i work 20 hrs per week. However i havent had payment since 18th dec as this is when partner moved out, i made a new claim and just yesterday they contacted me saying they wanted all this extra info bank statements, work contract, last 3 wage slips, nursery reciepts and nursery contract. Semt all this to them today. Thing is i know i have been over paid by about 40 per week since june, should have mentioned it i know, however as i havent had payment since 18 dec they owe me around £1500 in back dated money, do u think they will take what i owe them out of this lump sum or do u think they will take it weekly?

Don't hold your breath, but do keep on at them. They still haven't sorted out the overpayments they'd made me in May 2004 (and I reported it the morning they paid the first amount in). We only get a v.small about of child tax credit per week but their computer apparently erased my other halfs details and treated me as a single parents and started paying me shed loads of working tax credits!!!
I am absolutely sick to the back teeth of tax credits. I have been nothing but up front and honest with them and they never get back to you just send you printed letters spat out by a computer! If you start to get hassled go to your citizens advice and from now start logging down every call and what was said because I went through a period where I got told a different thing every time I called, file every letter because you'll need it one day.
Good luck

When they made the assessment it was average over the year so if you had a change in June & didn't notify them they could nil you for the rest of the financial yr or until its all paid back.

Yes u can appeal & claim hardship but you've knowingley been defrauding the system thats meant to help people, for all of the faults of tax credits your doing yrself any favours

Just claim ignorance then claim hardship.................they are not allowed to leave any family in financial hardship...

Say you can't keep a roof over your head with that much being taken etc they will work a payment plan out that will suit you and them if they pick up on it................

I was overpaid and refused to pay the money back because it was there mistake and they didnt pursue me, for the money

( I cant understand why I got some thumbs down, if you had seen my charge from the Inland Revenue for late payment, for my tax return, they ended up with the money back and some lol)

They can't take what you owe them from the joint claim with your ex out of the new claim as a single person. They'll have to make a seperate arrangement to collect this off you and you can always try to negotiate it to an amount you can afford.

They will work out the amount you are due since your new claim and if you owe them any money they will ask you to repay it,They will however allow you to make arrangements to pay it back in installments.
