Yes, once you beat someone over the head with it. If you are asking if Police will react with lethal force against someone who has an unloaded gun pointed at them....the answer is YES.....any officer who sees a gun always assumes it's loaded and operational.

In a legal definition it is! However, unloaded, of course it's not...but just a side note....
If the weapon is used illegally...whether it's loaded or not...by law it's still a lethal weapon and considered loaded!

For what purpose? In what jurisdiction? It is impossible to answer the question accurately without knowing these things.
Just guessing, I would say that it probably is for purposes of unlawful possession of a lethal (the usual term is deadly) weapon. For an assault charge, it would depend upon the jurisdiction, but probably yes as well.
