I am active duty, i just hit my 2 year 1 month. I am going thorugh a MEB, i have Lipomas(tumors) in my lower back. Never knew they were there until i joined the Army. The doctor trired to remove them but it was not so sucessfull. Now i have this different kind of pain in my back from the surgery but the army says that they are not liable because i had the tumors before i joined, but i had no idea.

It is there responsibility to provide you disability not only for you back but also for the Tumors.

Reasoning behind this is you could have gotten these after you joined, it had never shown up in any medical records before the you were in the military (RIGHT) and if they didn't catch it while you went through MEPS they cant prove it was a preexisting condition. If they new you had tumors when you went through MEPS it would have been stated and most likely you would have had to have them removed before enlisting.

As far as the new pain in you back you should receive compensation either from the doctor that performed it or from the military (in the form of disability)

I had 2 unsuccessful surgeries on my shoulder, and I to have new pain in it. It doesn't bother me I not the kind of person out to get anything and everything. I can still work though and I just make sure I tell everyone not to go to him and if they are referred to him ask for a different specialist. Dr. K Pal of Lubbock TX (Orthopedic Surgeon), if anyone gets referred to him ask for another.

I also have been MEB, after you are discharge you can go to the VA and get revaulated and get a higher disability raiting if approved.

The Army may not be responsible for your tumors but they are responsible for the surgery performed on you!

If there was malpractice invoiced in the surgery, then, if you can prove it, you have a chance of a case.

Go see an Attorney, who will prob. advise a 2nd medical opinion about your back.

Its not their responsibility to look after you like a child.
