A really good friend of mine is having trouble gaining access to his 4month old baby daughter. he pays monthly for her but the baby's mother refuses to give him access to his daughter. Any advice here would be welcome, if the child was born out of wedlock does he have rights to the baby?

We live in South africa and he is a great father and has no criminal records.

I don't know the laws in Africa but in Utah the mother can keep child away from bio father until there is a court order for visitation, even if father is paying support. My advice would be to have your friend contact a lawyer and find out his rights.

As the biological father he has rights to the child. HOWEVER if the child resides with the mother unless there is a court order she doesnt have to let him see her. Frankly and I hate to say this my husband is a great father but I wouldnt let him take my son for visitation at 4 months of age. Hell my son is now 8 months and if we divorced it would be expressly written in the visitation that it would be in home visitation. Why, simply because most men do not know how to react properly to a childs needs. When my son cries he automatically assumes its because he is "spoiled" and nothing is wrong. Plus he doesnt seem to be able to smell his diaper rotting off his butt. However he has a soon to be 7yr old from a previous relationship and this child is beyond spoiled but we wont get into that however when she's around its like our child is invisble.

I don't know about South Africa but in the USA fathers have rights and can sue for them. Is the mother keeping the baby away out of spite? what kept the parents apart? maybe he needs to try to make amends with the mother.

In the US, if a father is on the birth certificate he and the mother have equal rights concerning the child. Regardless of whether they are married or not. The only way to have anything official is to go to court to establish custody, visitation, etc.

a child's father has rights even out of wedlock, especially if his name is on the birth certificate. i had a falling out with my fiance and tried to find out about him not having access to the child (immature of me but i was really hurt).

the laws may differ but unless she can prove he is a threat to the child she can not take all rights. he will be given visitation rights, limited but better than nothing.

As a father he has rights to his child. He needs to go to the courts and file for visitation with his child.

Well, what do you mean 'access?" babies this age cannot leave their mothers without being harmed, so only visiting at mommy's would be good for a child this age. is there someone to help arrange visits? if not, see a lawyer.

he should have some right to her. but its really up to the mother unless he gets the courts involved.

get a lawyer, not being married did not stop her from getting support, file for visitation without lawyer if can't afford one,
