If so how much do you have to pay out of pocket before you can claim it?

You can claim your medical expenses on your Schedule A of your federal form if you have enough expenses to itemize. Medical expenses in excess of 7.5% of your income is deductible as itemized deductions.

i believe this is an IRS rule. there is a standard deduction of somewhere around $3500. anything over that can be claimed, but it has to be a medical necessity (no cosmetic stuff). Also, this only benefits you if you have a large deduction and itemize your returns (i've asked my tax guy about this before)
