My 9yr olds fingers were severed in the hinges of a door at school. Thankfully with plastic surgury they've been reattached. Its taken 2 lots of plastic surgury and 12 weeks of pain and grief, physically, mentally and financually. Can we be compensated by the school or not?

did someone force her hand into door? She put her own hand in door way didnt she. Look you try the best you can, but kids sometimes do goofy things. Where is your daughter right now? Look she could hurt herself at home doing the same thing? Does that make you a bad parent? Should she be taken away from you cause she did something she shouldnt. Look you watch them the best you can and things sometimes happen. Its tragic but it is also life. You can not watch them 24 seven. Teachers are no better than you. And for the people who pop off that they get paid, well you know parents dont get paid and they are fiercly more protective for free.

Would you believe the state would have good cause to try to take her away from you for her safety if she had the accident at home?

If not, you should not punish school for accident at school.

I would contact a personal injury attorney. It depends on what was happening at the time-did she put her fingers there when common sense of course says not to. Which would mean she is liable for her injury.

To the person below. My child was in a toy store (a very large chain with a long necked animal as its mascot) trying a bike out, that we were considering buying. The bikes tires were not properly aired up, she went to stop and it would not-she ended up running into a end-cap. We thought that she had possibly broke her finger, the nail was almost completely ripped off. We filled out an accident report and took her to the emergency room. Her finger was not broke. A ripped off fingernail is a far cry from fingers severed. We hired a personal injury attorney he thought that it was cut and dry-the toy store refused to even compensate us for her emergency room trip. To me they were completely liable, they have their bikes out to try, they did not have this one assemble correctly, etc..

Ouch!! Hope she's feeling better.

Yes, the school should be carrying insurance for exactly these types of accidents. This accident obviously needs to be investigated and safety needs to be improved, no door in a school should sever a child's fingers! The school will probably counter-sue the builders who selected the doors and it will become a big legal tangle. In the very least, you should be compensated for the medical bills and the school should be inspected for other safety issues. You may want to look into another school for your daughter in case this one does not take kindly to being sued.

How is it the schools fault, should they install curtains instead of doors?

Accidents happen, unfortunately this one is a grave accident - but it could have happened at home as well. Or at Grandmas, or at a friends house.

Just be thankful that the fingers were able to be reattached. Also, that wasn't a school shooting or another student pulling a knife.

If it is a private school, they should have insurance for every child. You need to prove the school was negligant. You should be able to be compensated in some regard by the school in any case!! This happened to my aunt's friend a day ago in NYC. The baby is 2 years old. Hope your daughter gets through this!

use your head... the school is 100% liable especially if her fingers got severed in a doorway.. and to the person above, unless she stuck her fingers in and shut the door on them all by herself then she can not be liable, she's 9 years old... schools are responsible for taking these kids age into consideration
