I got careless driving and the cop told me it would be 3 points on my license. I took traffic school to remove previous points 6 months ago so I cannot do that. Will these 3 points raise my insurance rate? Also, I was pulled over by an unmarked detective, and he called in a motor cop to write the ticket. Would it be worth taking to court, and if I take it to court, what are the benefits vs. the losses I can face?

Most likely, when your present insurance company eventually renews your insurance they may become aware of it. But it really depends on the insurance company. If you decide to change your insurance company, the new company will definitely be aware of it.

It may be worth going to court to at least try to plead it down to a non-moving violation but then be expected to pay a higher fine and surcharge because, believe it or not, the fines are usually higher for some of them. I sometimes think this this is why some courts don't hesitate too much in reducing a speeding violation when you appear before them (just my opinion though).

Lastly, although I see your point, I'm not really sure if using the unmarked car as the reason for argueing the ticket is a good idea (because in essence you are still admitting that you were speeding) but I do think that it may play a part in being the reason you could. It will be the officer that wrote the ticket that will be the one appearing in court if you appear. Logically, that officer wasn't the one who observed you speeding and by law I would think, but am not sure, how can that officer argue that you were speeding when he did not actually see you? So if you argue that you do not beleive you were speeding (I'm assuming that that's what you're saying) and that it was another officer that pulled you over, the judge may question it and it may get dropped.

Basically, taking the time to go to court can't hurt. By doing this it at least gives you a chance to have the charge dropped or reduced. It seems to me like most judges will reduce a speeding violation to a non-moving violation just by appearing before him or her and showing that it concerns you (it may show that you're being responsible) but I live in a small town so not sure if my perception on that is accurate.

Well, lets put it this way ... they sure are not going to help you or your insurance costs.

BTW.... Insurance companies can also see the previous conviction (the one you went to traffic school for ) although may not factor that into your rate. The points may come off but the violation stays on the record.

As for the ticket... it doesn't matter who wrote the ticket, you have two options.

1) If you did not do the 'crime' then fight it. Or, if there are mitigating circumstances, you can go to court and ask the judge to reduce the violation (that may or may not reduce your fine or the points).

2) If you are guilty as sin (grin) you can still fight the ticket, taking the gamble that BOTH the cop who wrote the ticket based on the statements made to him by the detective or the Detective himself will not show up.

This is likely why the detective summoned the patrolman as his time is generally not well spent pursuing traffic issues (you must have REALLY p*ssed him off - right?) . If the officer fails to show you will likely walk. If the Detective fails to show you can possibly argue that the patrolman acted on testimony from the Detective and that his (patrolmans) testimony is not best evidence. Therefore the failure of the Detective to appear prevents you from presenting your side of the case. Who knows...it may fly.

Only you can decide if it's worth it to go to court. Unless you aren't guilty of whatever you were pulled over for, it's probably a waste of your time to do so. Yes, three points will probably raise your insurance rates for around 3 years. Had you finished your probationary period on whatever you went to traffic school for? If not, it will also now show up on your record. Doesn't matter who pulled you over if they had the authority to do so, marked or unmarked.

You might think about not doing whatever it is you do to get pulled over if you want to continue driving.

Yes it will, and it takes 3 to 5 years to come off of your record. Drive more careful if you can't afford high insurance

I've heard that if you were ticketed by state patrol, it might be worth contesting. However if you were ticketed by local police, probably not. The theory goes that local police are closer to the courthouse, so they are more likely to show up, and also that they pay more attention to doing the process right because the ticket money has a closer effect.

Your case is also complicated by the fact that you have two law enforcement witnesses (the ticketing cop plus the unmarked guy) and not just one.

your insurance may go up but sometimes it doesn't.Take a defensive driving course and that will eliminate 4 points off and 10 percent insurance reduction.Oh I see you already have,
QUIT SCREWING AROUND,YES YOUR INSURANCE IS GOING TO GO UP AND I HOPE THEY GET YOU OFF THE ROAD.I AM DRIVING MY CHILDREN AROUND OUT THERE.
