College or Highschool? It's fine either way, however I would try to remember how you felt and acted when you were a freshman (college) if he's away from his parents and everything and is out meeting all these new girls and, you may be thinking he's a great guy and wanting a relationship while he may be playing the field, I know I was much more reckless with peoples hearts when I was a freshman, and wanted a more serious relationship when I was a junior

Alot would depend on the age difference. If, lets say he failed a year or so then your age difference wouldn't become a legal issue. If you really like this guy, it shouldn't matter what grade he is in. The only other problem would be that when you have graduated and off to college (hoping you will go) he'll just then become a junior in High School. So then what will you do? I don't foresee this being a long term thing, but what do I know.
