On the stretch of road I was traveling on, the speed limit was 80 in the day and 65 at night. The time was around 7 o' clock so it was night, but still light enough for me to see pretty far ahead.

I actually saw the vehicle to the side and thought it might be a cop. So I slowed down, but then i figured it was a car on the side of the road, and I checked my speedometer and thought I was alright. Big mistake.

I have already received a moving violation about 6 months ago for not stopping fully at a stop sign and took driving school for that.

So my questions focus around:

1) Since I'm moving to Tenessee, technically still a resident of CA (and have a CA license) and received the ticket in TX. What are my options at this point?
2) Can I dispute from another? I hear those don't have a good chance of winning.
3) Would I be able to take traffic school? How would that work?
4) How much would 2 pts affect my insurance?

Hire a TX attorney. See if he can plead it down to a no-points citation like defective equipment.

First of all, unless you want to go to traffic court in Texas, I would just plead guilty and pay the fine by mail. It may cost less than actually taking the time to go there. To argue a traffic violation, you will have to appear before the judge. There is a possibility that if you do go to court to argue it that your speeding ticket may be reduced to a non-moving violation. But expect to pay a higher fine and surcharge for a non-moving violation.

Secondly, a speeding ticket received in Texas will most likely not ever show up on your California license and your insurance will not be affected. I am also assuming that you may eventually exchange your California license for a Tennessee license, in which case the speeding ticket would also not be an issue because they will be looking at your California drivers abstract.

Texas does not use points. You would have to appear to ask for dismissal. You can request defensive driving. Just contact the court listed on the ticket before the court date and ask what the proceedure would be for out of state defensive driving. Also in Texas the Judge can allow up to 2 defensive driving courses in the same 12 month period so the one six months ago should not matter. There will still be an admin fee charged, but it will keep it off your record and away for the ins co eyes.

The ticket is only good in the county where you received it. I would suggest that you check with the Ca DMV and ask them if your license will be suspended if you don't pay the ticket. If they tell you it will, then pay the ticket. Other wise you will not only have to pay the ticket but also a re-instatement fee.. it is not worth it.. If the dmv says that you license will not be suspended then your ticket will only remain in effect in the county where you received it..Just don't ever get stopped in that county again..Also, if you want to settle the matter, you should be able to call the county and ask them if you can send a reduced amount as a settlement.. of course one alternative is to get your TN license as quickly as possible. If the CA liscense is suppended, it won't matter much because you have already reliquenished it..Check with the TN dmv for a clarification.. don't something that will cause you trouble in the future, like I said, it is not worth it.. Pay it and go on..

Just pay the ticket so you don't get your license suspended.


Don't believe anybody who says you license won't be suspended if you fail to deal with it. The one thing that is linked is those computers that send out failure to appears. It might take a year (my case), and they might not be able to tell you where it came from (my case again), but you will get your license suspended eventually unless it is resolved. Cheaper to pay the ticket, right and wrong don't matter. Convenience is the key here.


Also note, the joker saying get a TN license missed the part where they ask for your CA license and two proofs of residence in TN (I live there now, so trust me).

Just pay the ticket.

if there was no sun in the sky and if this just happened so sunset ws before 7 it was night speed limit at night is 65
most places will let you take a school if you havent had a ticket in 3 years but since you said you had one 6 months ago i think your out of luck

and about the 2 points it depends on age and sex your insurance CO how much they will raise your rates

i own a repair shop,and live in Tennessee and you,d be better off just paying the ticket,its 2 points and its not going to hurt you that much,fighting it is almost a loosing battle,plus court cost,and if your like me your time is valuable also,so id pay it and go on,if you decide to fight it you have to go back to the state you got it in,on a certain date,id mail them a check,and be done with it,I'm telling you from experience,you never win these things,good luck,i hope this help,s.
