a few days ago i got the EIC form sent in. It states that according to my finances ect.. i may be entitled for a refund. after reading it carefully i took it to my accountant to review it but said it was not good. it says that the child has to either be 19 or 24 and in school.
is the information of the child supposed to be based on this year or the year the EIC state (2004)

my child is currently 26 and was 24 in 2004 and was in school at the time.

he was 24 on that date 12 31 04 and school and he was 23 and in school the yr before (2003)

I'm assuming you have a child between 19 and 24. If so, the child must have been enrolled in school at least 5 months of the year for you to claim the EIC. The EIC is based on your income. Check the instructions for the tax return for more info. You can call the IRS toll free number as well listed in your phone book. Hope this helps.

If your child was 24 on 12/31/2004 then he is too old to qualify you for the Earned Income Credit.

Was your child in school in 2003 and in your household? You may be able to get some EIC by amending your 2003 return.

To get a refund on an amended 2003 return it must be submitted by April 16, 2007.
