I got into a car accident where i was in a right lane and a guy was next to me in the middle lane. I was driving in his blind spot but i would have eventually passed him...if he hadnt gotten into my lane. He changed lanes even though i was next to him and he forced me onto the curb. I just wanna know whose fault is it? Some people say i shouldnt have been driving in his blind spot...but i say that he should have checked his blind spot because its impossible to always avoid driving in peoples blind spot.

You're not supposed to pass on the right! Lots of people do, but they aren't supposed to.

If the person was only looking in the mirror, and didn't look back, then he's probably at fault for what happened.

He hit you, so it's his fault. But try not to pass on the right. n

Since you are technically behind him, even if in another lane, you are guilty, you should have yielded the right of way to avoid an accident.

You admit you were in his blind spot, so you obviously were aware of the possible danger before the accident, you could have avoided it.

Did the other driver signal at all? If he did and you still got into an accident, this reinforces the fact that you should have yielded the right of way.

The other driver will probably maintain that since he was ahead of you, he was watching other traffic ahead of both of you, and you should have backed off or slowed down and let him in, and technically he is right.

If no tickets were issued, then I'm betting the insurance company will find you at least 70-80% responsible for the accident.

Generally you should stay out of another drivers blind spot, but he is the one who didn't turn around and actually look before he changed lanes and hit your car which makes him 100% responcible.

It's HIS responsibility to CHECK if it's SAFE to change lanes.

There is one basic law: you may not do ANYTHING if it's not safe to do it.

if he came into contact with your car , then he is at fault
