my boyfriend and i had just been drinking so we decided to park off to the side. we went to the backseat and started making out and feeling each other. we stopped after a while and i saw a police car pulling up to next us. he said it was having sex in a public place is illegal, but he left us go with a warning. is what my boyfriend and i did really illegal?

I would say that, technically, what you were doing is not illegal. However, it probably did appear that you were having sex. And that is illegal. What I would suggest, is if you do it again, park in a more private place where there wouldn't be any passing cars (including the police!). ;)

It is illegal to expose yourself in public, and it is illegal to perform lude acts in public.
Besides being illegal, it is just plain rude. If you are within sight of other people, or where they are driving by, you could be seen. Imagine if you were driving by with your little daughter and suddenly had to explain why that man was attacking that woman in the back seat and why mommy wouldn't stop to help that lady.
That may be a little extreme, but not entirely impossible. You get my point.

yes..it is illegal..
It is considered "Public Indecency" and "Indecent Exposure"..plus Im sure there are a few more things you can actually be charged with..
consider yourself lucky you both got away with a simple warning...
