I am behind on my car payment by 1032.50 and the best I can do for now is give them 300.00 tomorrow. The Well Fargo representative threatened me, harrassed me and scolded me. I told her we are waiting for our W-2 to come in the mail so we file our taxes. Refund can pay off the balance we owe. Not the whole loan but it would bring us current. I also told her we would be taking an AD out in the paper too to see about selling the car. She went into a rant about how stupid I am and why didnt I do this months ago when my husband lost his job. I told her our situation and all I got was too bad lady we will take the car. What options do I have?

Pay them what you have. That should placate them for awhile but you really need to make each payment on time. If it's a few days before it's due and you know you won't be able to pay, call them and let them know. Someone will usually try to work with you. This applies to almost everything from credit cards and utilities. If they see that you are trying to do the right thing, they will work with you. If you ignore them becuase you don't have the money (we have all done this at one point or another) they assume you are a deadbeat and they call you and start threatening.
Just be proactive.

Pay them the most that you can.
Be cordial to collector - don't take it personally, after all, you are failing your end of the obligation. Try to see if they will accept payments every day you get paid or try some kind of repayment schedule that you can afford. The only way you can get them off your back is it get current and if it means sell the car-- do it.

If your lender continues to call you "stupid" and goes above and beyond any legitimate collection attempts, you should file a complaint against them with the FTC. (Federal Trade Commission)

My quick math tells me you are at the repo magic number. $300 will not do it. EVERYONE says they will pay current when their taxes come in. Do you know what Collector Person thinks? They thonk you're stalling. They know you have other bills to pay. Rent, food, electricity, beer.... Then you say you're going to sell the car. YOU DON'T OWN IT! THEY DO. Can you borrow the money from a relative to pay the loan current? I'm surprised the collector didn't tell you that. They will repossess if you don't become current. The repo man comes at night, watch for him.

You should pay as much as you can as soon as you can. That said, if they yell and you send a payment, they 'learned' yelling gets you to send money. The will yell more expecting more money. Until you are current, they will never get off your back. What is legal has little to do with what they will actually do.

Make the payment, as soon as possible. Hide the car somewhere, as the repo man will be out looking for it. Keep making payments, until you are out of "hot water".

They can repossess the car legally but they CAN'T harass or verbally abuse you.
