but i don't think he did it, i seen the bite mark today that the guy had on him,
first of all it was on the inside of his ankle and he was riding a bike. doesn't that sound like he lying ? it does to me.
second, he had 3 dogs chasing him in all, he told the animal control that he doesn't know if he was bit or scratched. based on that statement, then he didn't actually "see" the dog bite or scratch him, so how can he be sure it was my dog?
do ya think i have a chance to win this in court.
btw the bite marks are nothing more than little scratches. here is a pic of the pit and tell me that if this dog bit him that it would do more than a little scratch.

just asking for opinions, any kind of suggestions and links to websites will be greatly appreciated.
right now he is in the animal shelter for quarintine for 10 days.

to answer a few of the quest. ya had,
my pit doesn't go running around the neighborhood, but i had 3 kids here that accidentally left the door open and let him out. we tried to get control of him immediately after he got out. he did chase the guy but not for very long. i know he shouldn't have gotten out and that was our fault, i will pay the ticket and take responsibility for that. but i really don't think my dog bit him,
as far as the other 2 dogs that were chasing him, they are still out running loose around the neighborhood, animal control did not even go try looking for them. when she did finally see one of them running loose she refused to take it saying she didn't have time. my dog is the only one in trouble for this.

you have a beautiful pitt bul maybe he is just trying to blame someone and found it easy to blame a pitt bul because of misconseptions people have about the breed but people like that dont understand that its not the breed its the people. anyway if its just a scratch im pretty sure that you could win it because if he would of bit him on his ankle his *** wouldnt be walking

Unfortunately for your dog there is one big problem with the story you let your dog get in the situation. It is a bite or a scratch right (it doesn't matter). You AND the other dog owners are responsible why? 2 reasons
1. Where was his leash
2. Why wasn't he in a fenced yard
For these 2 reasons you are responsible unfortunate it will be your dog that pays for this. In the future properly protect the dog from these type of situations. You will probably be investigated now to make sure you are a responsible owner. I seriously doubt you will get off on this because your dog was there and did contribute to the incident be thankful it wasn't worse. The only thing that may help you is going after the other 2 dog owners for part of the amount you will have to pay to get it split.
EDIT. I understand you think paying the ticket is enough but, its not. Accidents do happen but we have to ultimately take responsiblity for them YOU admit your dog chased him anything he did out of reasonable fear ((this is a loose term) will be your fault . Call in the other 2 animals (everyone has a boss find hers) proving the other 2 are running wild will help you go after the other 2 owners for their part in the damages. Find any witnesses who may have seen all three animals chase himyou aren't going to get off on his injuries you need to focus on splitting the bill. I would get innsurance on your animal that way if a situation lik this ever happens again you can deal with it through the insurance company. My daughter was bit by a lab we weren't sure if it was a bite or a scratch(happened very fast) it wasn't until we saw a Dr that the Dr said it was a bite. The court will side with a Dr so if the Dr says its a bite its a bite. I wouldn't waste the money in court trying to disprove the bite it could be done possibly by having an expert$$$$ measure bite radius to the marks on his leg but, that might just prove it was a scratch.
I don't care what kinda dog you have it will still end up your gate was open dog got out pay up.

I'm so sorry to hear ur poor dog has got blamed for "biting" this person, and I'm shocked to here ur dog has been removed from his/her home and placed in quarantine 4 10 days!
given the facts as u say there was little more than scratches on the cyclists ankle And it was on the inside ov his ankle as well???
Do u by any chance live in the UK ?
we have a BIG THING going on right now "if it could be pit bull" its removed from the home (coz they r all dangerous)! yea right!!!!
I truly hope u get ur lovely dog back home very soon, and id like to add if u do please don't allow anyone to have the opportunity to place him in this situation again, keep him on the lead and under control.
hes a lovely looking dog, and I've got my fingers crossed for him ;)
Good Luck

3 dogs chasing the guy? then that guy better get more proof then saying that one of them was a "pit bull". He probably thinks that just because it was a pit, that he will win the case. I also don't think that your dog would do that, and if he did, I don't think a strong dog like yours would have done "scratches", but a "complete bite". Does it make sense?

Can you prove at all that your dog was not outside running loose when the alleged attack happened? Unfortunately, with your dog being a pit bull, people will automatically make assumptions. Regardless, though, you should not allow the dog to roam free outside. If he was, you may have a tough road ahead of you. All of which isn't the poor dog's fault; I feel badly for him.

If the guy can't keep his story straight, I think you have a chance. Sounds to me as if he has a fear of pit bulls, and put the blame on your dog. And YES, your dog would do more than a few scratches if he was to go after someone. Inside of the ankle...hmmmmmmmmmmm? Riding his bike...hmmmmmmmmm? Put 2 and 2 together, he probably scratched himself on his bike! He was probably feeling a little threatened by 3 dogs running after him. Can't blame him, but he should be honest!

First off - Beautiful pit.
Second - If he said he didn't know if it was your dog or another and can't even say that it's a bite for sure then he has a very poor case. More than likely your dog is easiest to target because of the pitbull reputation.
That is BS! There are no bad dogs only bad owners.
Just out of curiousity....what where the other two dogs that were chasing him and are they in quarantine also?

I think maybe you should make a compromise with the neighbor instead of taking this to court cause you could end up losing the dog and paying huge fines for this . good luck .

It sounds to me that they have no way to prove who bit or scratched him. However, you need to keep your dog under control at all times, no matter WHAT breed it is.
