No, it's not illegal at all The only requirement is that you actually do everything you say. But sticking to the letter of the law makes such advertising a no-brainer. Assuming you sell the identical product from the same manufacturer and a customer walks in with a printed ad and asks you to beat your competition's price, all you have to do is quote a price $1 lower than the price your competitor quoted in his ad.

Though I think depending on the item the retailer can be a little more generous. He is, after all, making a sale he might not otherwise have made. In any event, no MP3 players are ever given out.

It's not illegal to be aggressive although the wording can be tricky. Most states have laws regarding specific wording in advertising. Some industries are more heavily regulated than others - automotive advertising, for example, has much more stringent laws.

And by the way the mp3 player is probably crap. And it might be something you have to send in for.

No, it's not illegal, but make sure you CYA by doing everything you advertise. I won a suit through the DA one time because the car that was sold to me was nicer than the car in the ad, and a week later they wanted more money for it.

sounds like you may go in the whole if you give away gifts without a purchase. not illegal just ignorant.
