i have been with my common law married boy friend for 5 years and we have been filing together with three kids we are now seperated can i filing as single with 2 dependants and we files seperate with 1 dependant

You need a divorce to file as single, its the status on Dec 31,2006 that decides your status. If you live in a common law state then you are married until you divorce him.

There is no such thing as a common law divorce. Once the IRS considers you "Married", you are married. You can file as Married-filing Jointly or Married-filing Separate but not as Single or Head of Household.

If you were common law married, then just separating doesn't change that - you have to get a divorce to become unmarried.

So until you do, you could file as married filing separately, but could not legally file as single.

Of course you can file separately. As far as claiming the kids, I would talk to a tax pro.

To be considered a dependent the child must be "related" to the person who claims them.
Check with a Tax Professional ....
