My husband and I moved in September...my husband said that we probably can't claim moving on our taxes because we did it in september, is this true?

It really depends on WHY you moved, not when. You can only deduct moving expenses if the move was job related. If you moved because your job required you to then it is deductible no matter when you moved.

If you moved for ANY other reason then it is NOT deductible.

This is for the US tax laws as I understand them. I am not a tax professional by any means. Your best bet is to get in touch with a tax professional or the IRS and get a professionals definitive answer.

It doesn't matter when you moved but rather why and how far you moved from your old residence.
You would have to have moved because you started work at a new location. You would need to meet a distance test which is that the new work location is at least 50 miles farther from your old residence than the old place of employment was from your old residence. During the 12 months after moving you must work at least 39 weeks at the new work location. And, the move must be because of employment at a new location, not necessarily a new employer.
If you get form 3903 the questions on the form will lead you through the tests and help you determine what you can deduct on your 2006 tax return.

If it happened in 2006, it goes on the 2006 return.

The only question is why did you move?

Only expenses for a work-related move over 50 miles are deductable.

The time of the year has nothing to do with it. If the move was for job purposes and meets the requirements to be deductible, then deduct the expenses.

Why not? You moved during 2006. Claim it on your '06 taxes.
