File the claim with your own insurance company. They'll work it out with the other parties insurance company; that's what you're paying them for.

Get your police report, which usually lists the other person's insurance company and policy number. Call the insurance company and file the claim if you haven't already. If you have already filed against that person and their company is not responding to you, you have have two options. 1) Keep calling and worry the ever-loving sh*t out of them or 2) file on your own insurance and have them subrogate against the at-fault party.

Call the insurance company, then call them again. They are not in any hurry to give money out. Call them every day if necessary to check on what's going on.

huh........think this might be in the wrong place......like maybe it needs to be sent to the insurance company..........
