We got married in Dec. 10. My refund is garnished totally for child support reasons. She has a 17 year old daughter. Our plans at this time are to file separately so her tax refund won't be touched for my reasons. Can she still file single head of household since she was single for 11 months of the year

No, now that she is married to you her only choices are Married Filing Jointly or Married Filing Separately. A married individual living with their spouse can NEVER file as HoH.

She may be able to preserve her share of any refund by filing a claim as an injured spouse. See the IRS website for more information or consult with a professional tax adviser (CPA or tax attorney).

Kinda sucks, I got married on Nov. 26th of 2005, and lived separate for the WHOLE time. We did not live in the same house until Jan 13 of 2006 when we bought one together, but we still had to file married for 2005. Its your status on Dec 31, of the year, but she should be able to file innocent spouse relief. good Luck.

No, Head of Household is no longer an option for her.

File jointly and then have her file and "injured spouse" form.

If her daughter turned 17 in 2006, then she can no longer get the Child Tax Credit for her.
