There are no dependents and he only works part time. We've lived together for 3 years and I've always filed single. I was told I could amend my returns for the last 3 years. I don't want to do anything illegal.

Whoever told you that you could file as Head of Household was misinformed.

Head of Household means that you pay over half the costs of maintaining the home for a qualified person. A qualified person is a relative who is your dependent (or nondependent child for whom you have waived the dependency exemption to the noncustodial parent).

The rules did change in 2005, but in 2003 and 2004 the person still had to be a relative, but not necessarily a dependent.

If your partner had less than $3,300 in income, he may be your dependent, but he will not qualify you for Head of Household filing status.

ninasgram is correct. Your partner is not a qualifying person for you to file as head of household, although if he didn't make over $3300 in 2006 and meets the other requirements, you might be able to claim him as a dependent.
