Capital murder is when a murder is committed in the act of and additional crime(robbery, rape, car theft, burgulary) capital murder carries the death penalty according which state you live in.

If I remember a capital murder has to involve a secondary crime such as rape or robbery. Or the primary crime such as rape or burgulary turns into murder. I may be wrong here but I remember such an incident happening in our town not long ago...
A couple of men broke into a home with 3 men and 2 women. They stole items from the group. Raped the women and sodomized the men. Made the friends do the same to each other at gun point. Then took them to a field made them strip off all their clothes in the dead of winter with snow on the ground and shot them all in the back of the head. There was a lone female survivor. After they left the group for dead they backed over her with the vehicle that they stole from one of the guys. She then managed to run naked to a house to get help all the while suffering from a bullet wound to the head and numerous other physical injuries. When the men were caught they were tried for capital murder, found guilty and are now on death row...

It depends what state you are in. All states have something to the effect that the individual showed a "depraved indifference to human life" IE they are sick. In addition, killing a police officer or killing someone in the commission of a felony are usually included too. (IE you shoot someone and kill them while robbing a store)
