Military member and spouse live in Panama City, FL. He claims residence in KY. She worked all year in Florida, however Florida has no Income Tax, Does she also pay Kentucky Income Tax?

Excellent question sure to get all sorts of responses. Military tax filings with states are really wierd.

The military person will not be taxed by the state of deployment...only by the state of residence listed on his/her W-2. The spouse, separately, must figure out which state they are a resident of. You need to read the residence rules of KY to see if KY still considers them a resident. If so, then they will have to file a Resident tax return with KY.

I just finished reading the on-line KY instructions and they don't define residence. For most states, residence is defined as the place you own a home that you have your mail sent to, the state where you have a drivers license issued to, the state where you have bank accounts and stuff. It is sort of ambiguous sometimes. My guess is she followed you to Florida and became a resident of Florida prior to starting work. If that is the case, she needs not include her Florida income in your KY tax return. In that case, I'd recommend filing a "Married Filing Separate" for KY and "Married Filing Jointly" for the feds.
