the lady i bought him from emailed me today and asked me to check and see if he had both, and to my surprize he has only one, i guess another male in that litter has only one too. now heres my question. when i bought this puppy it was for breeding to my two females, they all are well bred and are show quality, this lady knew what i wanted him for, this is very hereditary and i can not breed him. he is five months old, i told her i should get my money back and that i do not want him,she said he had them when i bought him at 8 weeks so she will not take him back, is that possable that he had them then but not now. Do you think i'm wrong asking for my money back? this lady is a big time dog shower & breeder. i payed good money for this dog and can't afford to take this kind of loss, and on top of that it will cost about $380.00 to get him neutered.I plan to cream this so called big time boxer breeder,s name all over the state of calif, i will be at every dog show she is at with that male

Wait, she claimed that he had both his balls at an earlier age, but now he has one? What nonsense! Those things don't just wander off...Or at least I hope not. If she knew that you were buying that dog for the express reason of breeding him, then if she were a reputable dealer she wouldn't WANT him to be breeding if he has problems like an undescended testicle. I dunno, it would have been helpful if you both had signed a document saying what qualities the dog must have (good for breeding stock in your case) for it to be a legitimate deal, but since that's not the case it sounds like you might face some problems in getting your money back.

Talk to your vet. At 5 months, he should have been to the vet a couple of times, did they notice he only had one???? Did you sign a contract??? Does it say for show/breeding?? Some breeders have in the contract a kinda "fine print" that says show/breeding quality NOT guaranteed. That is understandable, since no one selling a pup can give a 100% guarantee that it will mature to that potential, but some breeders hide behind that for this kind of thing.
I never buy a male puppy without a report from a vet that has examined the litter and it states for each male if there are 2 testicles descended or not. Was there a report for this litter????
I would never buy a pup from a breeder that did not have the pup examined by a vet before a sale.....for this very reason!!!!!
You need to consult your contract and any vets that have seen this pup up until now. At this point at least a couple of vets should have seen this pup.
If the testicle truly is not down, you should get your money back and be able to return the dog.

Boxers have a higher incidence of cryptorchidisn than any other breed. Cryptorchidisn is when one or more of the testicles are retained or remain undecended. Quite often the retained testicle is sitting right in the channel but has never completely dropped into the scrotum. Reasons for this could be an obstruction in the scrotum or even a shortness of the cord attached to the testicle. Not all of these are in this position. Some are retained in the abdomen and should be surgically removed as soon as possible since retained testicles are predisposed to develop Sertoli cell tumors. Dogs that have retained testicles, even if one is dropped into the scrotum, should not be bred since cryptorchidisn is considered an inherited trait.

If she is indeed "big time" then yes, I'd ask for at least a partial refund.

You can get your money back. The dog's testicle wouldn't drop at 8 weeks and then simply vanish. She's either an idiot, or she's a liar and a crook.

Do NOT alter the dog (once you make any permanent changes to the animal it's legally yours and she won't have to repay you.) And do NOT defame her (she can sue you if you do.)

Instead, give her 10 days to take the dog back and return your money, and then sue her in civil court if she won't comply (and file the suit on day 11; don't wait). It doesn't matter if your contract made any specific reference to body parts; you and the breeder came to an agreement that you wanted breeding stock and she was selling you breeding sotck -- and she breeched that agreement the instant she sold you an unfit dog.

You don't have to take another pup from this breeder if her breeding stock isn't up to par.

Get an afidavit from a vet stating that testicles don't "disappear" as she contends they do, and that he inspected the dog and believes it is not suitable for breeding. (If you've got a good vet who will come to court with you, all the better.)

If you win, which you likely will, the court will make her pay any attorney's fees or court costs you incur. The legal action will go on her record and may also impact on her credit rating.

If she's a registered breeder, also report her to the club or agency with which she's registered (after you win your lawsuit). They may be able to pull her registration (which will prevent her from selling unfit dogs in the future as "registered" animals) and they can also ban her and her stock from future shows if they want to.

Dogs don't have testicles one minute and not the next. At 8 weeks it was probably pretty hard for the breeder to even feel the testicles in the scrotum. They don't usually drop until 3-4 months old. It is a hereditary condition and I would not breed this dog. I understand your frustration. Good luck getting your money back

It is possible for a testicle to go back up again. There have been pups that have had both down at 8 weeks and one has gone up again. Did you check this pup when you got him to make sure he had both? Is your contract for breeding or show? Or does it just guarantee pet quality? Check your contract closely to see what it reads. You can get in touch with me through my profile and I can take a look at it. Some breeders word their contracts so that they can get out of them, so the contract needs to be read before you get the pup. Does she offer a replacement guarantee? If she only offers a replacement, then you probably can not get your money back.

http://www.siriusdog.com/articles/cyptorchidism-congenital-testicle-dog.htm Read this article by Fred Lanting please. The testicles should descend before birth. I check pups around 2 weeks of age for testicles. Now they can be hard to feel at this age. I have a 4 week old now that has both down. Last week I could not feel his right testicle, but both are definately down now. You should be able to get your money back from her as she sold him to you knowing you were going to use him for stud. I seriously doubt his testicle will come back down now at his age. It might, but I doubt it. I have seen a dog that had both down at 8 weeks and I took him back at 11 months and he only had one! So this does happen.

Check your contract. Many breeders offer a 1 year health guarantee. Also, in the contract it might say something like "Seller guarantees the dog specified above to be free of any genetic defect which would render the puppy unfit as a pet." If it does, then you have a legal leg to stand on. I can't believe a reputable breeder would sell you a pup without taking him back if he has a problem.

Good luck with you!

It is extreemly rare for testiclesto drop at 8 weeks and the asend back up into the abdominal cavity. Get your vet in on this one, have him write up his professional and medical opinion about this situation.

If you purchased a high quality puppy for breeding, no you are not wrong to ask for your money back because as a responsible breeder, you can't breed this dog - unless you wanted to keep him as a pet and have the breeder cover the cost of the neuter.

Check your purchase contract and genetic health guarentee, a retained testicle (Cryptorchidism) is GENETIC....

I would recomend finding another breeder to find your stud stock.

You want to breed your dogs, and you didn't notice until someone pointed it out that your stud dog only had one testicle? I'd be sceptical about any of them being show quality if you didn't even notice something so obvious wrong with his conformation. FYI breeding dogs is always a loss if you do it properly. Maybe this dog saved you from making a big mistake.

If this is a reputable breeder you should have a contract that would cover Cryptorchidism if the dog was sold with breeding rights and if you paid for breeding rights then should be able to return the dog and you are owed another dog. A lot of times a breeder does not refund money they will only replace the pup.
