service with that same question and they will not reply, when i was lucky enough to speak with them on the phone the told me to look on the web site for my answer, even after i told them i could not find anything, bottom line is they will not give me the information and i can't find it, but they say i must have the waver, its really a mess trying to get help from them, about my wife, she was in the states but i took her back to her mom in mexico until we get this fixed, because INS said we had to do that first, THEN after i return to start the documents INS says they are going to bar her from returning to the usa for 10 years because she left on her own, first they tell me to do it, then punish us for doing what they said, iv'e been married 6 years to my wife and have met all guide lines on income and have and approved I-130 document for my wife, but can some one tell me how to fix the I-601 WAVER before i run out of time, or is that the plan INS has for me, please help me some one.

You might have to contact me with more info but here goes. Your wife got caught in a catch -22. She could not adjust here if she entered without a visa and if you filed the I-130 after 04/30/2001. If she was in the U.S. more than 6 months out of status, or undocumented she has to go to Cd. Juarez for the visa interview. Once she leaves the U.S. the 3-10 year bar kicks in, basically she imposed the bar herself by leaving the U.S. The I-601 is a waiver that can grant relief to her bar, but you have to prove an EXTREME HARDSHIP to yourself and any children you and your wife may have. You have to state your hardships in a sworn affidavit and submit it with the I-601. Emotional and financial hardship alone is not usually sufficient to approve the waiver. I-601 should have been submitted to the consulate at the time of interview or you should have been advised to return it to the consulate immigration section. I-601's are taking about 9-18 months for processing due to a backlog of these applications.
