The Dea raided our house and found almost 400 plants and all the equipment needed for the hydroponic setup. Suprisingly enough, after handcuffing the four of us, in the end they only took my guy and his partner and let us girls go. My boyfriend did have priors for possession of small amont of marijuana in the past. How much time do you think he will get? What are the louisianna laws for this?

It depends on whether they can convince the court that the pot was for their own personal use, as oposed to for dealing. They are very tough on drug dealers, even pot.
400 plants does not have a huge yield, so it is conceivable that it could be for their personal use. Then it would just be a possession charge.
this will make a HUGE difference in the amount of jail time. IF they determine that it was for dealing, not only could they serveover 10 years in prison, also the govt. can seize the house, car, and anything else they believe could potentially be used in their "business"
If they determine that it was for personal use, it just becomes a possession (albeit a lot) charge, maybe a year, 2 max in jail and probation after that.
IF you get a good lawyer, they can make the case. They might get off with probation, maybe a fine.
But either way, they can kiss the pot goodbye!

With no priors, I would guess he will have to serve at least a year in the pen.

This is a serious felony offense.

I could be wrong, this is my guess based on what I saw defendants get 10 years ago in Texas.

You really should consult a well versed criminal defense attorney in the jurisdiction he was arrested in.

Check the NORML website. They will have the laws on a state-by-state listing.

You came here looking for sympathy, didn't you? You're not going to get any. The only use for druggies is to test new hand loads on. Hope he enjoys his life in prison. Find yourself a boyfriend that ISN'T a loser. In your case that sounds like it is going to be impossible.
