My friend and I were stopped in front of a bar on "suspicion of public intoxication" --it was clearly a sting. Nevermind the illegality of their sting, when they detained us they confiscated my .38 special and a .22 short barrel pistol I was carrying. They never did file charges for public intoxication (no evidence), but they haven't returned my guns. What is the process for getting them back?

I have no "carry permit" and I have no license because I am not REQUIRED to have either. Know the laws before you spew.

Nearly every state is an OPEN CARRY state--it is legal to carry firearms (VISIBLE) without a permit. It is in Arizona. If you believe you need a permit to carry guns, then you obviously don't own guns, and you don't know the constitution, which means you neither deserve nor appreciate liberty! I was not carrying a concealed weapon--I was carrying a holstered weapon.

The first question that comes to my mind is why are you "not required" to have a permit to carry them? If you were carrying them concealed, I know of no state in the Union that allows you to do that without having a permit...and of the 50 states, only 38 of them have CWP (Concealed Weapon Permit) laws. In the other 12 states you can't carry at all.

If the weapons were confiscated because you were carrying them illegally, you're not going to get them back. Ever.

As for the sting being "illegal," I doubt that very seriously. You just think it's illegal because it caught you.

My suggestion is you get an attorney and see what your chances are of getting your weapons back, but I wouldn't be too hopeful about it if I were you.

It's interesting that you aren't required to have a FOID card. I suppose it is possible that some states don't require this. I'm assuming you live in the US.

If you weren't charged with anything, you should call the police department that confiscated your weapons and make arrangements to pick up your weapons. If they have a problem with you doing this, they should notify you that there's a problem.

More than likely, you will need to go to the station and sign for the return of your property.

How is it that the "sting" was illegal? It's not illegal to make a public contact and temporarily seize a firearm while the firearm is on the property of an establishment furnishing alcoholic beverages! Just because you're outside the bar....the property goes to the curtilage!

Start by calling and asking them. If they were not registered, they may be able to keep them.

you dont get them back probably.....police took your guns-you dont get them back.. Just like if the police took your drugs, they obviously wouldnt give them back
