My brother (26) is on medication and talked with stranger a 10year old female by grabbing on her hand, someone who saw this called police and police after found out he was on medication, but still they(police) filed case. now he has been charged for disorderly conduct. My brother can’t work or live by himself. He said he didn’t even recognize she was a 10 year old. We don’t have money or gas to travel 700 miles for his court appearance. What we have to do?

one of his old school good friend took him from his own expense to stay in his rented studio for couple of weeks just to see if he will be alrite after spending with his old friends. our badluck

The test is if he knows right from wrong, If he does in fact know right from wrong then he is subject to the charges, but if the court determines that he does not know the difference then they could dismiss.

Contact NAMI (the national alliance for the mentally ill) in the state he;s in they have help and resources to help him out or can refer you to folks who do and specialize in that sort of thing

Worst comes to worst there are attorneys in his state where he is being charged who work with the National Legal Aide Society they often work for little or no cost

I've dealt with worse myself here in ohio and this really doesn't sound like much the judge can do to him

I think the worst your brother may get is up to 120 days in a mental hospital where his meds will be stabilized and possibly a referral into a group home where he is and they will make sure he is well taken care of and well fed so don't worry about it

He may also end up with probation in court

But if he seriously hurt the girls hand civil court is another matter...........

Depending on how hard her hand was grabbed durring the altercation the police were called in on they can come after the family for the girls medical bills if it broke bones

But I don't think from reading it that it was that bad for dammage

Contact the court and tell them you dont have money or gas to travel for the court appearance. See if they have any suggestions. Also I would ask the court clerk if there is any free legal aid available. Good luck.
