As with any question about criminal liability, it is impossible to answer without knowing the State. In California, false imprisonment is a misdemeanor, with a maximum sentence of one year. If it involves violence, menace, or fraud, it is a felony with a maximum sentence of 3 years. What sentence would actually be imposed would depend upon the circumstances of the offense and the offender.

That depends, if you imprison someone, lots. if the government does it, you don't get any of it back.
