I have been to different Oktoberfest celebrations in different communities and a lot of them are held in different months. Is that legal?

OMG, everyone is wrong. Oktoberfest (in Munich, Germany) is the last half of September! It ends the first week in Oktober.

Oktoberfest 2006 went from 16 September - 3 Oktober.

Oktoberfest celebrates the end of the harvest. Traditionally, a lot of brew was made to celebrate the harvest.
October in the Southern Hemisphere is in the spring, so having it in the month of October would make no sense.
And the closer to the Equator you go, or due to variations in climates, the sooner or later the harvest generally is.

It is suppose to be in September. It is a festival celebrating October, I believe it is their fall harvest.
