Not legally. If you use something like TurboTax and file on your own, nobody would know that you'd done it as long as when you get your W-2, it matches your last paystub (they don't always). It's wise to wait for your W-2.

A paid preparer is doing something illegal if they actually file your return without having the W-2. They can prepare it ahead of time, just can't file it.

H&R Block has a commercial out right now stating that they can do your return with your last paystub; however, I strongly advise against it. Your last paystub may not reflect enough info for them to process the return correctly, and you may end up with a lower refund than you should have had. W-2s have to be mailed out by Jan. 31 - it's only a week away, and I'd just wait it out.

i dont think you can actually file with it but i think you can get an estimate, some places even give loans
