My old apartment complex from a year ago apparently filed a collection against me which i just found out about today. They filed it for carpet cleaning services when i moved out. I was never contacted about this and they had my forwarding address. I have been told by the collecting agency that they attempted contact and the apartment complex said the same thing. The problem is i never received any kind of notification. My record was spotless before this and even if I do pay this off right now my record will still be dented. What should I do?

1) request validation of the debt from the collection company - tell them you want proof that they paid for the cleaning. Don't do it in a rude or abraisive manner.
2)Keep track of when you request the validation. Keep any proof you can, such as sending by priority mail.
3)If they haven't validated the debt after 30 days, contact the credit bureaus to notify them that the debt wasn't validated within 30 days as is required under fcra.

If they validate the debt, pay it. Your credit report will be updated.

inform the collection agency that you "want written notification". This written notification must tell u 3 things...

1. The amont of debt you owe.
2.. Who the original creditor is.
3. What to do if u do not believe u owe the money.

U must notify the collection agency IN WRITING preferrably via CMRRR that you do not believe the debt is yours and that you are requesting proof of validity of the debt or judgement against you....they must then product this documentation...If they can product this documentation...pay the bill..it is yours...if they cannot provide this documentation...they will simply go away..they have about 60 to 90 days to provide this documentation. IF U DO NOTHING...this has the right to appear on your credit report on the 31st day after receiving written notificiaton.

File a complaint with the credit bureau and get tough with them. Try it for yourself if not get a lawyer. If you had no notification when you rented the apartment that they were going to clean the carpet and bill you they had to notifiy you 1st in form of a certified letter so they had evidence of contacting you. Be tough because with the information you give out they can be charged with fraud.

Try to make a deal with the apartment and collection agency. Tell them you will just pay it, even though they did not contact you if they will take it off. Otherwise, tell them you are going to get a lawyer, etc.


Or, pay it and forget about it. Much easier option, but it does suck to have a black mark for this.

Ask for a copy of the invoice for the carpet cleaning. In addition, ask for a copy of all written attempts at contact. Don't just take this from them. Make sure they did what they were supposed to, or get them to fix your credit report.

Also, why didn't they take it from your deposit?

relatively I dont see what distinction it will make using fact in case you have a collections debt that hasnt been paid your score is probable low besides. and that i in no way relatively heard of paying it off inflicting your score to drop a minimum of no longer severely. in case you choose vehicle there are a number of self finance sellers who will sell you a vehicle.. activity may be extreme yet thats an decision.

Once it is paid, the collection agency MUST remove the report within 30 days. That's the law. Even though its not really fair since you weren't warned prior to collection, unless you want to fight in court, it'd be easier to pay the agency.

Yes. I strongly urge you do that right away. Unless you pay that bill, that will linger on your credit report for seven years. You might even be dragged to court over this unpaid bill (a very likely scenario).
