My partner stopped claiming the above benefits 1.5 years ago.

HMRC are now asking her to repay £2,450 because she failed to return an application form (they say).

Has anyone else had a similar thing happen?
She was entitled to the money and surely the payers have a duty to chase these forms as a % will always get lost in the post?

Any tips / help appreciated.

BTW we are both full time, hard-working taxpayers, not scroungers!!

i am having exactly the same problem at the moment.they say i sent a form back late nearly 2 years ago and need to pay back all the money they have given me £2900.i tried to sort it out but they say its my mistake and must pay up.i was given untill 12 december to pay, i have not paid a penny and am waiting to hear from them again.i am going to my local cab office to see if they can help.
if as they say i sent a form back late then why have they been paying me for the last 2 years.the hole system is a joke

No they don't have a duty to chase the forms. It is your responsibility to make sure the relevant forms get sent on time. Whether that is fair or not is another matter - but thats the way it is.

You can appeal against repayment, but since they followed the rules the chances of you succeeding in an appeal are minimal. The only way you'll succeed with an appeal is if they gave you incorrect information which it was reasonable for you to believe was correct.

You have to join the club I'm afraid - you are one of thousands caught up in this Tax Credit farce!

The problem is they won't listen to what you tell them because 'THE COMPUTER' says you are wrong!

The way to resolve the issue is to get onto your local MP and bring it to their attention! The questions are being asked by MP's regarding this farce!

You have another option - Go to your local Tax Office and take all the paperwork with you and demand (not ask) to have the matter resolved today! If you don't make demands to resolve the issue, they will pass on the details and you will be back at square one again!

Don't bother with the Tax Credits helpline - they are useless on matters like this because they do not have the authority to make changes of this type to Tax Credit details - it goes onto another department and as you can guess - their computer doesn't talk to the other computer - the staff don't talk to the other staff even though they are seperated by one office!

Bureaucracy at work!

We are all being driven crazy by this scam, promises of help that turn into being in debt to the government. Don't want to be pesimistic but from my experience it is just one big mess that gets bigger and bigger and this God dosn't have a face or a phone number. If you find a way to sort it please let the rest of us know.
