what if they have taken you to court but you had no idea that they had took you to court do they automatically win

it is for a car note but me and my husband wages are already being garnished for this they garnished him first then garnished me my last payment to them was in nov so why are they still trying to get more money i consulted a lawyer he said that they can

Nobody can take your federal refund for private party debts.

If they have a judgement against you they can freeze your bank account but only the amount that is in it when the bank is served with the garnishment. Any funds deposited after the garnishment is served and the freeze placed are not subject to the garnishment.

By the way, if they obtained a judgement against you, you were sued and a case legally presented before a judge. Why didn't you show up for court? If the debt is legitimate why didn't you pay it in the first place?

You should have been notified, possibly through a certified letter, that you were being taken to court. If you didn't show up, then yes, you automatically lose.

Depending on what the debt is for, they might or might not be able to take your federal refund. The refund can usually only be taken for federal or state debt including unpaid student loans, and for overdue child support.

Only government entities can. For example, if you've defaulted on your student loans, they automatically get it.
