My husband is deployed right now, so I filed our income tax with a POA, everyhting was going good and then today the lady from H&R block said they could not give me my return because the IRS has a hold on it. She said it may be for past debt to the IRS, but neither I or my husband do! So could there be another reason?

Unpaid and overdue school loans, or overdue child support would be two possibilities. Also any other debt to the feds or state.

You could call the IRS and ask them.

World Net Daily is a joke. Maybe you should read the trial transcript of My Cryer's criminal trial. He beat the rap on CRIMINAL charges by proving that (even as an attorney, albeit a Louisiana one) he was TOO STUPID to understand that he was required to file a return and pay taxes. What the linked article fails to mention is that he LOST the CIVIL case and paid the taxes, plus penalties (totaling over 150%), court costs, attorney's fees, etc. His final out-of-pocket cost all in was around TEN times what the tax bill was in the beginning. Maybe he IS that STUPID after all. Quoting trial transcripts out of context (as you do in Stapler) is dishonest and disingenuous. The part you copied describes the plaintiff's allegations, NOT the ruling in the case. Go back and read the ENTIRE transcript and get back to us on that. Moreover, you have cited the wrong case -- it's Staples v. U.S., 21 F.Supp. 737 (D. Pa. 1937) -- and the final sentence doesn't appear at ALL in the trial transcript. Some tax protester kook MADE IT UP. Claiming that the IRS isn't a government agency simply shows your extreme ignorance. The IRS is part of the Treasury Department. Given that the Secretary of the Treasury is a member of the President's Cabinet, the IRS most assuredly IS a government agency. So, in the end, if you don't pay the bill (plus the penalties and interest) the IRS will simply help themselves to your wages, bank and investment accounts, and any other assets that it can locate. If the US Attorney decides to file criminal charges you might be able to beat that IF you can prove to a jury that you are TOO STUPID to understand the requirement to file a tax return when ordered to do so or pay the tax. The IRS routinely holds refunds for a week longer than the normal cycle for the purpose of verifying some of the information on the return manually. They do this to about 5-10% of ALL returns every week. They have been doing this for 15 year or more.

The IRS will hold a refund up even longer if A)they suspect fraud; B) there is a genuine problem, such as someone e-filed and then mailed in a paper return within days of e-filing, C) there is an outstanding debt owed to a government agency.

The IRS WILL NOT tell your preparer why there is a hold. They will not tell you either. It's their perogative to hold your refund for up to 46 days without a reason. If they hold it longer, you are entitled to interest.

It maybe due to owing money from previous taxes, owing a financial company (student loans, etc), or back child support.
