i'm just wanting to know if they'll take both state and federal. i can handle taking state, cause it's the lesser of the two refund checks we have coming.

The states and the federal government act as collection agents for each other.

So, yes they will probably take both refunds if they have their act together and the data is current.

Unless he has more coming back than is needed to pay off his debt, then yes, sounds like they'll take it. If he has more coming back than he owes, he'd still get what was left over after his debt is paid off along with any fees and interest.
