I worked for 3 lawyers and they each paid me separately. One of them never even notified the government that I was an employee. Chances are she isn't going to follow through with anything. It's only about $1,200.

She won't even get back to me if I call. She hasn't paid her own taxes. What if she doesn't do anything??

Did you get paystubs from this apology-for-a-lawyer-who-gives- other-lawyers-a-worse-name-than-they-deserve? Did she deduct FICA? if she did, you are in Easy Street. If she does not issue you with a W-2, call her and ask. If she does not respond, wait until February 15th and fill out a substitute W-2, based on your paystubs. That way, you avoid reporting it as "1099" income and avoid paying her share of the FICA.

If she did not deduct FICA, you are going to have to declare the income and pay SE tax on it. All told, the extra SE tax will cost you less than a hundred bucks over what you would have had deducted. Probably isn't worth the fight, but its your call.

I'm not really sure but I think I'd try contacting this employer and request in writing a W-2 form. That way you'll have something in writing that you made an attempt to get it so you can show IRS. Good luck.

Call and tell her, don't just assume she didn't report it.
That is the fast track to getting audited.
It may have been mailed to the wrong address or lost OR because they really aren't due until the end of Jan,
Maybe it hasn't been sent yet.
