I have a friend that paid 500 for a slow dog from her breeder that she got 2 other healthy puppies form. she also helps her own like ,grooming,whelping and what not.

so anyway Poeky was born and he didn't get alot of air when he was born so he's kinda slow. My friend knew this becasue she was there when he was born. the breeder wanted to use him for breeding stock but as he got older he didn't grow outta the slowness. so the breeder took him to the vet to be fixed.

A year goes by and my friend desides that she wants to take him into her home. so her and the breeder work out a deal to sell him for 800. my friend gave her 500 so far but ended up spending 300 in vet care for poeky so i told her NOT to pay her any more money. she found out that poeky has hydrocephalous, the breeder has not returend emails ,phone calls,and will not give her any reocreds. so my friend wants to know if there's any lemon laws for some thing like this?

Yea , that's what i told my friend that i'm not sure if there's anything to be done because she knew that he was slow.

bear, your RIGHT!! he never should have been SOLD he should have been given to her. yes an MRI has been done.

the only thing that was signed was the AKC papers. the rest was word of mouth. and my friend only paid the breeder as pay back for fixing him(i told her she shouldn't have, but she felt it was the right thing)

she knew he was slow but she didn't know he had water on the brain and that's what she wants to know the dog laws. Becasue i feel the breeder knew,because once she told her she stopped all contact with her. She doesn't want money she wants the vet reocrds which the breeder isn't giveing up!!

Your friend took the dog knowing there was something drastically wrong with him. I don't believe in culling, but he should have been placed in a special needs home after he was neutered. I can't believe 1. the breeder sold the puppy and 2. your friend paid $500 for it.

Go to your local STATE Attorney's Office. They might be able to assist your friend, however, with her taking the pup knowing he wasn't right from birth, she might not get anywhere!

If your friend and this breeder are/were such good friends, I'm sure she knows what vet the breeder used.

Doesn't cost no $500 to spay or neuter a chi. I have dobermans, and it didn't cost but $180 to get a female spayed, and she's an 80 lb adult.

Did your friend sign any contract? I highly doubt it since your friend was aware of the birth defect.

The breeder was wrong for selling the dog in the first place, as to your friend who was going to give the breeder $800.

Your vet needs to keep all vet records and reciepts from the vet. Contact your state's Attorney General's Office. Despite even if your state has a lemon law, this may be null and void with your friend fully aware of the birth, the situation, and so on.

The only person who cold know is your Attorney General. Most states (mostly all the states) have a website followed by .gov. Do a yahoo search, type in your state, and find the state's website. Through there you can find the website for the Attorney General's Office, plus other laws and statues. Good Luck.

Give your attorney general's office a call and ask about the law in your state. Has this dog had an MRI or CT to diagnose this? A shunt can be put in, which might help. He might end up with other problems later on. This breeder never should of sold this dog. If she wanted to place him as a special needs dog, then fine, but she never should of sold him! I am glad he is neutered.

I don't know where you are, but for most countries the contract you sign with the breeder is about all you can depend on.

Most reputable breeders will create contracts to make sure that their dogs will go to good homes.

As far as I know, it is the risk you take when you buy a dog and courts cannot do too much about it.

there is nothing she can do she took the dog knowing full well that he was slow and had problems . Yes the condition he has is common in chihuahuas it is better known as water on the brain . Just forget it cause it is not worth the hassle or the pain .
