Probably first, because the "2nd placer" status in only earned when the race is over. So here you overtook the person who finished second sometime before the race was over. If you held on to your position, you probably finished first. The question is at what point in the race did you over take "the 2nd placer" and did anyone else also do so? So you really can't say for sure what place you are in without more information.

if the second placer gets disqualified and you end up with the title "2nd place" its a moral decison. your medal might say you got second but you know that you were the 3rd one to pass the finish line
