my gf is an immigrant from mexico and she has been in the US for more than 10 years if she marries me, I was born in the US,
can she still get a green card and eventually apply for US citizenship ? "I heard this is not possible anymore"

To answer your question, I do not know. But I do know that it should not be possible.

Yeah, all you got to do is pay a $1000 fine since she is living in the states illegaly, but other than that, she will be a legal resident as soon as the application for citizenship is in. The only thing, she can't leave the country for the time immigration decides, most of the time a year. But after that, she will get a legal resident card, which will help her apply for any job as if she was a U.S. citizen.

It depends. The law has not changed: if she entered legally, then even if she has overstayed, you can marry her and apply for immigration and a green card for her. If she entered illegally, it will be extremely difficult. You really need to talk to a good immigration attorney - be careful, there are a lot of bad ones out there.

You could also ask on the immigration forum Yahoo group. There are a couple of good lawyers who answer questions there.

If she has been here for ten years and is legal she doesn't have to marry you I don't think. But yes, if she marries you you can apply for a spouse visa and she will be issued a resident card and then will eventually be eligible for citizenship.

that is no longer an option. my husband became a citizen in feb of last year, he's also from mexico. she can still apply but will have to go through the whole process as you as her sponser. it took us about 2 years for him to become a legal permanent resident and 3 more for him to do his citizenship. good luck

I'm betting the US citizen was USED by this dude to commit marriage fraud. Seeing as how the illegal is already married, HER marriage is a sham. It means the American chick is SINGLE with a felon's kid. So she makes bad decisions for herself. NOW let's see if she eff's up her child's life by staying with this sperm donor. Because daddy is the role model from hell and the citizen is in denial to think otherwise. She needs to realize her poser "Hubby" is attending Criminal College for the next 5 years. Her child can be proud that daddy is taking classes in: Breaking & Entering 101, Intro to Assault with a Deadly Weapon, and Advanced drug sales & distribution. She must LOSE the last name & move on or doom that child to a life of shame.

After you have been married for a certain number of years, it used to be 3, she can apply for citizenship.

She "legally" can't marry you because she can not provide adequate identification for the marriage license.

I --believe-- the "shortcut" around that is to take her to Mexico and marry her there and then bring her back to the US as your wife. I'm not totally sure on that, so I would suggest looking further into it first.
