I was out at a restaurant with a few friends last week in NJ. My pal attempted to buy a beer and was carded. He told the waiter he was 21 and said he left his ID in the car. He said he would go get it and we all subsequentely left the restaurant.
Is my friend or I in any legal trouble? I know it is against the law, but if there was not a cop there, can/will the restaurant call the cops and file a police report? What will be the consequences? Will my friend or I be arrested or will it just be a citation? How can I find out?

Chances are good that the restaurant won't call. The place won't want to risk losing business by making more trouble.

No the eatery more than likely will not try to file a report. They can do it if they wanted to, but they would have to prove that the person that was trying to buy the alcohol was a minor.
From the info you gave, there is not going to be any consequences.
No neither of you will be arrested, and if you were caught by the police trying to buy the alcohol, then it would more than likely be a citation.
If your question of "find out" is asking how you can find out if you are going to get in trouble, the answer would be that you would already know.
If the question is referring to finding out what could happen to you if you were caught doing this, then you would need to consult your state's penal code and look it up for that charge. It will tell you what exactly you would have to have done to commit the crime, and then it will even tell you what the maximum punishments are for that crime.

Wow! Youth with a conscience. No the restaurant will not file a police report, it will serve them no purpose. They merely saved themselves the risk of being charged with Contributing to a Minor and you surrendered your table so they could serve another patron. Calling the police and filing a report would have only contributed to a waste of time and an inability to continually serve customers. After all if this establishment serves alcohol, the last type of car they want parked outside is a police car while the officer takes the report. That would drive other customers away.

I assume you are trying to just take a chance that you might get away with it. Believe me its not worth it. By trying to buy the beer you are creating the assumption that you are old enough whether you show the ID or not. So when they ask for your ID and you don't have one you are still guilty of trying to purchase alcohol while a minor. If you are lucky the store person will just tell you to leave. If you aren't then you will go to jail. If the seller were to sell to you and someone reported it, he would get a major fine and possibly lose his license or a suspension of license where he couldn't sell liquor at all for a certain period, like 45 days. None of these penalties make it worth it for the seller to sell to a minor.

I'm not in Nj. but, here it is illegal and a criminal offense for a minor to attempt to purchase alcoholic beverages. It is an arrestable offense, but usually the minor is just cited and given a court date. Underage drinking is a serious offense... don't be involved. If you buy it for a minor you can be charged with a worse offense and arrested. just sayin.

Looks like you got lucky, but I wouldnt neccesarily try that one again. Most restraunts dont bother calling the police, because they dont want to attract a negative scene with the other customers around...also, if there happened to be a cop IN the resturant while all of this happend, you could actually get a ticket and points on ur license, reguardless of whether you drank any alcohol or not...the act of trying to pursue the beverage, is act enough, to guarentee you a ticket and some negative permanent information on your record. please, dont do this again...and i suggest that you dont hang around people who do this to, bc whether you did it, or were only with ppl who tried to get away with this, if a police officer sees you, then you are ALL in for it....

No way. the resturaunt has way more things to worry about than just chasing around a couple of minors. and you two didnt actually commit any crimes, so even if they did call the cops, they couldnt do anything about it. Your completely fine. DOnt even worry about it.

I really doubt they will report you after all do they even know who you are? But yes it is illegal for a minor to even attempt to purchase alcohol.

I don't think trying to buy alcohol is a crime, but if they'd sold it to you they'd be in a heap of trouble.
