That depends on what exactly you mean by your question. The networking protocol BitTorrent doesn't, neither does the official client version of the software. There are also dozens of other BitTorrent clients from other sources. Some of them may have spyware/malware, but if you stick with the larger clients from reputable sources, you shouldn't worry. Especially safe are the more popular open source clients, like the one I use: Azureus. However, anything you download could have spyware/malware in it. If you download pirated software, I think it's safe to assume it DOES have spyware/malware.

Torrent sites never have anything malicious because BitTorrent, TorrentBox, etc checks them, but LimeWire may contain spyware/malware becuase you can put ANYTHING you want there and nobody cares.
