Hello all
I recently had an accident in freeway. Initial investigations of my insurance company (I have full coverage insurance 25000$ per person and 50000$ per accident) shows that I am 100% at fault.
my question from you is: can the other party involved in accident sue me for bodily damage more than 25000$?
I know it is possible to sue people for anything but need to know how likely is that?
the other person involved in an accident was driving a car which I think was not worth more than 1000$ and he was arrested by police but I have no idea why and havent seen the police report yet.
I was thinking that he may sue me for bodily injuries that might become clear much later.
for example I myself have pain in my body and going to therapy because of that.

Of course he can sue you for more than your insurance coverage! Happens all the time -- one very good reason why you shold ALWAYS load up on liabiliity coverage.

Boosting your liability coverage doesn't cost much -- doubling it may increase the liability premium by 10% or so. Of course, it's too late to do that now, at least as far as that accident is concerned.

Bodily injury claims tend to be very high unless the injuries are very minor. An ambulance ride can cost more than $1,000 and a quick trip to the ER can easily exceed $2,500 for very basic treatment and release. The other party can also go after you for pain and suffering and lost wages. If your insurance coverage isn't sufficient, your wages can be garnished, your home taken, etc. to satisfly the judgement.

Short answer: yes. Practical situation: not bloody likely it will ever happen. If you happened to have crashed into a deadbeat bum that thinks they have just won the powerball lottery then he/she/it may retain a lawyer and try to soak your insurance company and you for early retirement. Your insurance company (like any decent company) will see right through this and fight tooth and nail to settle the claim for a reasonable amount. If the other party wasn't life-flighted away from the crash site and isn't in intensive care you will probably be fine. Let your adjusters handle this for you, don't have any contact with the other party, lawyer or insurance company without permission/direction from your adjuster. The fact that he was arrested on the scene is VERY favorable to you and very bad toward his creditibility. Stay frosty, drive carefully and thank your lucky stars you have insurance.
PS -- I would look into raising your limits if I were you. That could have been a school bus full of kids you hit -- then it's goodbye house.

yes he can sue you past the amount that your insurance will cover,,but all depends on what type person he is,,and if he actually has a lawyer involved with it yet,,id be concerned about why he was arrested,,even thought you was at fault,what he was arrested might play a big role in,how much he can sue you for,,or even if he can sue you,,id want to see the police report on the accident,,this might help you with the whole thing,,first id find out all i could about him,and why and what he was arrested for,and go from there,,good luck,i hope this help,s.

Hi might sue you for bodily injury and whatever your insurance doesn't cover you might have to pay. Contact your insurance and asked them, if they have received the police report, if not you can certainly inquire to take a look at the police station.
