I have friend who is going through some family issues. The father of her children and she were never married unfortunately and she has full custody and the father only has visitation rights. But now, she wants to move to another city but the father will not let them because he said that she needs his permission to move. Is this true? She said that he will still have his visitations. What's the problem?

Diana1, you have a valid thought! She is staying in the state and is only moving an hour and a half away. Also she says that she has sole custody and he only has visitation rights. They do not share joint custody.

She will have to pay for the transportation of the children to see him. He cannot stop her from moving.

It depends on what the court order says. I have not heard of one that stated that the custodial parent couldn't move to another city unless it was in a different state. If that is the case, she may indeed need his permission to move with the kids.

Yes if she has full custody she can move anywhere within the continuious 48 and not outside the country. He will have to make arrangments if he wants to visit. He gave up some of his rights when he didnt gain total custody.

Dont know the situation but she should move.
If he sues her it will take months before it reaches a courthouse, she can then explain the situation to the judge and let him decide.
He has less rights in most states since they were not ever married
I think she will win
and he probably wont have the money to sue her anyway
If she lets her dreams get away because of him then she will always regret it

The problem is that depending on how far away she will move it may or will be harder to see the kids. However depending on what state they are in the matter may go through the courts.

I'm not completely sure, but I don't see how she would need his permission to move. If she wants to move, I don't think there's much he can do to stop her, and I'm pretty sure he would keep his visitation rights still if that's what he's worried about.

She will have to check with the court that made the visitation rules.

That depends on where your friend lives. But here in florida she could move

thats fairly normal these days--not tough-family law sorts it out-leave it to them
