Page 20 of the instructions for form 1040 lists requirements to claim a 'Qualifying Relative' as a dependent. She must have less than $3,300 in income and you must have provided over half of her support for the year. I don't see anything about how long a qualifying relative must live with you. That test applies to a 'qualifying child'.

It's not a matter of legal custody, but of whom she lived with during 2006. She would have had to live with you for more than half the year for you to claim her. Unless she lived with you before the legal custody was granted, then no since August through December is less than half the year.

If she lived with you for over half the year and did not provide more than half of her own support, then you probably can.

If you provided 50 percent or more of her suport. Only from August to December however

Technically, she had to have lived with you for at least six months. If there is nobody else who is going to claim her, I say go for it.

you can claim for dependents but they do need to have lived with you for at least 6 mths before you claim.

not sure i thought it was six months but if you legally have her i would call a income tax company like hh r block or jackson hewiit

if you have supported her for at least 6 months of the year yes
