My husband is in the army, but I did not work in 2006 other than a small job in which I earned $1,773. We have one daughter to claim and no itemizing. For personal reasons, I would like to file separate and claim my daughter. Is this a mistake? Do you guys think I would get a desent return?

It is best to file married filing joint. Only way you can file without your husband and still get EIC is if you were living separately for over the last 6 months of the year and supported half the household, which you didn't making only $1,773. You should try to work something out with your husband. Here is the Pub for EIC..

The best way to know that is to get your 2006 form and fill them both in and see which one comes as to your advantage. The one that yields you a return would be the one to use.

Getting a decent return can only be established by trying both methods, joint or separate. Best wishes. By the way, tell your husband thank you for serving. He is appreciated.

Figure both ways and go with whatever is cheapest. But since your income is so pitifully low, I'd just about bet the farm that a joint filing would get you more money back.
